Auto Insurance Claims: who pays, insurance company, thay

I am writing on behalf of a friend, who is having problems with a closed claim.
He borrowed a car from a friend, was in an accident, which was his fault.  Do to
the fact that he only had liability, the driver of the borrowed cars insurance
company paid the damages on the other vehicle but did not pay for the borrowed
vehicle.  The owner of the borrowed vehicle submitted a claim to his company,
who then paid for his car.  He is now demanding that the driver of his car to
whom he gave permission to drive pay him for all of the damage on his vehicle.  
Can he do this?  I thought that the reason one has insurance is to protect them
against such things....they are both residents of ohio

Hi Susan,

It was the negligence of the driver of the borrowed car that caused the damage and therefore he is responsible for the damage. However, since the owner of the cars insurance paid for the damage, the driver would owe the insurance company for what thay paid out if they chose to try to collect it from him. The driver would only owe the owner for any deductible that had to be paid in connection with the repairs.
