States put different prioritys on enforcing the laws on their books, many times depending on the severity and dollar amount of the claim.

If the person who made the false claim report has not been areested yet, many times the person can meet with the insurance company, explain that they made a false report and if they have not been paid yet the insurance company will allow them to withdraw the claim without involving the police.  If they have been paid, but no arrest made, they may be able to make financial restitution and avoid prosecution.

Even if the person has been arrested, it's possible that the case can be resolved by making financial restitution.

There is really no clear answer except to follow the above steps and arrange the best deal possible.
