Auto Insurance Claims: Failure to Stop - Liability Issue, insurance premiums, liability issue


Question
My Daughter recently was hit by a driver who failed to stop at a four way
intersection.  At the time she approached the stop sign no one else was
there so she proceeded through the intersection.  A driver to the right side
ran the stop sign and hit her car.  The other driver called the police but they
did not attend only two trucks arrived at the scene and removed the
vehicles.  Claims were made by both drivers to the same insurance
company.  There were no witness when the incident happened but people
came out after the crash.  The insurance company is blaming my daughter
at 100% fault which will increase insurance premiums dramatically.  Does
the location of vehicles after impact have any worthiness?  It seems if the
other driver hit her, the vehicles would have been in different areas of the
intersection.
Apart from getting a lawyer (which we can't afford) I am appealing their
decision. What advise can you give to strengthen our case as she did
nothing wrong.

Hi Veronica,

Unforntunately, all you can do is give it your best shot. The is a classic "he said...she said" situation. Apparently the insurance company believed the other guys story more than your daughters. You just have to state your case and hope you win. In the end, about the best you can hope for is that they find liability to be 50/50.
