Auto Insurance Claims: collision settlement, state department of insurance, history of alcohol

I was involved in a rear end collision on 7-17-08. I had had a siezure. No drinking, no drugs, though I have a history of alcohol use. It is 12-23-08 and the insurance co. is still investigating the accident. Should it take this long? It took me ten days to get my medical records to make sure there was nothing incriminating in the records, and there isn't. Is the insurance company stalling by saying they are waiting on my medical records?

Hi Bruce,

No this is not normal. You need to call the company and demand to speak to a claims manager. You need to tell them that they have had 6 months to obtain medical records and that is sufficient. Tell them you want a detailed written disposition of your claim within 5 days or you will file a complaint with the state department of insurance. Then if they don't respond, file the complaint. That will force them to have to provide an answer as to what the hold up is.
