Auto Insurance Claims: denied liability coverage, texas department of insurance, cable bill

On July 9 a policy was in effective and it listed only my daughter and myself..I have a son, however he was not living with me..my son asked to drive the vehicle and ended up running a red light and causing damage (approx. 10k)to another vehicle..The insurance company refuses to pay due my son (19) being a family member who should have been listed on the policy...I have provided notarized statement from the person my son was living with...I contacted the State and apparently the State of Texas is requiring the insurance company to reinvestigate due to my receiving a letter from an attorney...

At the time I purchased the policy and on the day of the accident my son was not a resident of my home he was a permissible driver..

Do you have any further advise on this matter

Hi Brenda,

The only reason you are going through this is because it was your 19 year old son that was driving. Since you have submited proof your son does not live with you, everything should be fine. The more proof you can provide the better. If your son has any bills that are sent to him at his address such as a car payment, light bill, cable bill, etc, that would be the best proof. If the insurance company does ultimately deny your claim then you would file a complaint with the Texas department of insurance. Ultimately though, it may become a matter for a court to decide.
