Auto Insurance Claims: Claim Against Faulted Driver, squeeky wheel, case hi

Hello,
I was recently involved in an accident where I had the right of way on a 4 lane major street and the other driver pulled out of a fastfood parking cutting across all lanes and pulled up in front of my car and scratched my car.  The police already issued him a ticket and his insurance (Progressive) had called me to get my version of the story.  His agent then send an adjustor to look at my car.  Since then I have no heard back from this agent whom I have called and left message for but no reply from her.  Between the time of the accident until today it's about 10 days.  I just want to know how long usually does it take for her to write up an estimate and what my chances are getting my damage fixed.  (She gave me the whole story of how the ticket doesn't indicate fault and that her 'investigator' will be the judged of that)  I just get the feeling that she's avoiding me and will try to deny my claim.  Can she do that?  What are my options if that's the case?

Hi Susan,

Based on your story, it appears that the other driver is at fault. You need to keep calling the adjuster. If you do not get a return call then you should call and ask to speak to the adjusters supervisor. Unfortunately, you just have to keep calling and making noise. The squeeky wheel gets the grease.

It is possible that if the other driver gives a different story that they may try to deny your claim. If that happens, then you can place the claim with your own insurance company if you have collision coverage. If not then the only thing you can do is to file a law suit against the at fault driver.
