Auto Insurance Claims: Who is liable?, nussbaum, esquire

Question
I was signaling to back into a spot, and while I was
waiting to attempt to parallel park, someone else went into
the spot head first.  I didn't see them, and I dented their
car by the drivers side panel before the door (the door
can't open fully now).  On the one hand, i was signaling in
- on the other hand, I didn't see them.  Who is liable?
Thank you for your time!

Answer
Ari,

You have fault for backing into a vehicle that sounds to have been already present in the spot. If you had your signal on and the other person reasonably should have known you were going to take the spot and they tried to beat you in, they have fault too for their actions. Sounds like a 50/50 scenario. But a bit more fault could lie with you as they were in the spot first, even if you were there first.
