Auto Insurance Claims: Question about a medical claim., medical claim, claims adjuster

QUESTION: Hello, my name is Matthew and have a quick question for you. So i was rear ended about 2 weeks ago.  went to the doctors and they gave me some medicine.  so i was still alittle sore but not too much and talked to the adjuster over the phone on this monday.  she offered me X amount of money, not much, and she said she would send the release for me to sign and send back to get the check. now my neck is still sore and not getting better, so can i call up and be like i would like to get checked out before i sign any releases?

ANSWER: Hi Mathewm

You should not sign a release form until you have been checked out thoroughly. You may want to treat with a Chiropractor or other DR. for a few weeks before you attempt to settle. Just call the adjuster and tell her that your neck is hurting worse and that you are going to the Dr. and will let her know when you are finished with all treatment and will discuss your settlement with her at that time.

QUESTION: Thank you so much but one more question. so if they sent the release and check in the mail as long as i dont sign the release and cash the check the claim is still open and i can still get checked out and it be on the claim?

Hi Mathew,

That's correct. You should write a breif letter to the claims adjuster explaining that due to the fact that you are continuing to experience pain in your neck and back, that you are going to seek additional medical treatment. You should explain that since you are going to seek additional medical treatment it would not be appropriate to settle the claim at this time. Tell them that you will be back in touch with them once you have completed any required treatment and will discuss settlement at that time.

With your letter you should send back the check and release form you received.
