Auto Insurance Claims: liability, tow truck company, aaa card

Question
After my boyfriend was working on my car,it wouldn't start. He had it towed with the rear end elevated by the towtruck to the Ford Dealer using his AAA card.He paid for the repairs, and loaned me his car to drive.Over 2 months later, I've noticed substantial damage to the underside front of my vehicle. Is the towing company liable for damages? Who is?

Answer
Hi Ken,

Although it it likely that the damage was caused from the vehicle being towed, it is unlikely that you will be able to get the tow company to pay for it. One reason is that while it is likely that it was caused by towing the vehicle there is no way to prove that it was caused by the tow truck. Another problem is the passage of time. Since the car was towed two months ago, the tow truck company would argue that something else could have caused the damage over that period of time. You would have to be able to prove that the damage was caused by the tow truck. Unfortunately this is not possible.

I hope this helps
