Auto Insurance Claims: Car Accident, passenger doors, mid section

Hi i was involved in a car accident. I was traveling in the far right lane of a 4 lane 2way road (2 lanes in both directions)at around 15 mph and the other vehicle (traveling in the opposite direction)made a left turn right in front of me. My car struck hers between both passenger doors.

We both have the same insurance company (geico)... my agent has told me she accepted an offer of 85%/15%... 15% being my liability... she insists this is fair... i was wondering if this is actually fair and if ill be able to push for more considering i was traveling at half the speed limit and the other driver violated my right of way...

Hi Mustafa,

Their contention will be that since you hit the other car in the mid section instead of at the front, that you should have had time to see the other vehicle and avoid the collision. That is why they are atributing 15% of the fault to you. The other reason is since you are both with the same company they charge both of you more premium since you are both considered to be at fault.

You can certainly argue the point, but you will likely not win. But you should try as you may get lucky. After all as you said the other driver violated your right of way.
