My car was in an a accident, however I was not the driver but the passenger. When I called to make my claim I explained what happen.The insurance company some how twisted my words and said that I said I was the driver (I never said that)now they will not release the money for me to pay the auto body shop. The accident was not our fault we were hit in the back waiting for the traffic light.The other driver insurance company said there is nothing they can do because my insurance company had the car appraised. My question is shouldn't they cover my car damages because my policy has collision damage regardless to who was driving??? They are telling me the claim is under investigation and I'm without a car.

Hi Neka,

Yes your insurance company should cover the claim regardless of who was driving. The only exception is if the driver was someone who lives in your houshold and was not listed on your policy as a driver. It that case they can deny coverage because everyone that lives in your household must be listed on your policy as a driver.

You can also make the claim directly to the at-fault drivers insurance company. The fact that your company wrote an estimate does not matter. You can call them and tell them that you have decided to have them handle the claim because you do not want to incur your deductible. But you would need to call your insurance comapny and drop your claim there.

If you are not getting reasonable answers from either claims adjuster, you should demand to speak with a supervisor or manager.
