Auto Insurance Claims: Rear ender driver does not have coverage, value calculators, negotiation process


Question
I was involved in a rear ender, in California, and the other driver fraudulently gave me a policy number for a policy not in effect any longer. I contacted my insurance agency explained the situation and started a claim against my UIM. This is the first time I have had to use my own insurance for a bodily injury claim and I am unsure of what my rights and responsibilities are. Any information you can provide would be appreciated.

Since this is an uninsured motorist claim, your insurance comapny will not pay for medical expenses as they are incurred. Instead, once you have completely finished all medical treatment, you will need to assemble a demand package. Your demand package will contain all of your medical bills, medical records, diagnosis, prognosis, etc. You will type a demand letter that outlines all of your treatment and expenses, pain & suffering, etc. and then a total amount that you are demanding payment for. Then will start the process of a negotiated settlement. Depending on your insurance comapny and the extent of your injuries, the negotiation process could take from several weeks to several months.
