i wrote you a few days ago about my fiance driving my car with a learners permit and getting rear ended. the lady that hit us is not insured. so what do i do now?

Hi Stephen,
There are two possible ways that your own insurance company can cover your damages.
If you carry collision, your company will repair your car, less your deductible.  They will attempt to enter into a settlement agreement with the at fault party to recover the total amount of damage including your deductible.  If they are successful in recovering the full amount from the at fault party, they will reimburse your deductible.

If you don't carry collision, you may carry uninsured motorists property damage coverage.  If so, your company will pay the full amount to repair your car up to the uninsured motorist property damage limits, which is usually $3,500.

If you have neither of these coverages, then your final option is to file small claims court action against the at fault driver.
