Auto Insurance Claims: Subcontractor and PIP claim, pay stubs, wage verification

Question
My husband and I were rear ended 3/25/08. We were in a rental car and PIP has paid some of our bills. However, the PIP adjuster needs a wage & earnings verification sheet filled out. My husband subcontracts (exclusively) for a company and they are refusing to fill the paper out saying he's a subcontractor and it is illegal for them to do it. The adjuster won't take an average of his stubs for wage verification. What do we do? If we can't get his employer to fill the sheet out, we don't get his lost wages. If that happens, we can't pay our bills. Please help. We need any advice we can get.

Answer
Hi April,
It sounds like the General Contractor is being lazy and passing the buck.  I can see no reason why the adverse insurance company would not accept either the pay stubs or copies of the last two years of tax returns.  If the adverse company rejects both those ideas, you need to file a complaint with the department of insurance in your home state.
Just enter 'yourhomestatename department of insurance' into your web browser and hit go.
This will bring up many sites in your state involving insurance.  Scroll through until you find the on that states official home page of the department of insurance and click on.  They will list methods of filing complaints by telephone and by e-mail.

I hope that you find this information to be helpful.  Please write again if you feel that I can be of more assistance,
Your feedback by rating my answer will be appreciated.
