Auto Insurance Claims: Insurance Claim, parking lot accidents, insurance claim

Dear, Richard March 26 2006 I was in an auto accident in South Carolina. The accident took place in a gas station parking lot the officer could not make a decision on the accident since it was on private property. I filed a claim against the other parties insurance and the insurance company agreed to pay half of the cost, I told them no because the the other party had admitted fault and then several days later changed his mind after realizing the police could not fault anyone. It's been over two years since I heard anything any suggestions as how I should proceed.

The statute of limitations in South Carolina is 3 years so you better do something soon.

If your vehicle has not been repaired you can make a claim on your own policy and have the vehicle repaired. Then your insurance company will fight it out with the other company.

This is a classic one word against the other. You could file a law suit and see if the judge believes your story more than the other persons story.

Parking lot accidents can be very hard to decide liability. You may want to just accept the 50% and move on.
