Auto Insurance Claims: Who is at fault, speed limit, pickup truck

My son was totally stopped in school parking lot he was about one foot in the intersection around a curve so had to that to see who was going.  A pickup truck exceeding the speed limit hit his car, ripping off his bumper and headlights cost 2000.00 in repair. the truck no damage.. whois at fault?

Hi Mary,

It is difficult to determine liability with such limited information. However, if your son was sticking out into the intersection then he is likely to be found at fault. The oncomming traffic has the right of way. If your son was blocking the right of way then he was in the wrong.
