Auto Insurance Claims: Who is liable in this situation, rental car agency, rental car company

I rented a car a few years back and it was stolen from my residence and once recovered it had been wrecked. Am I personally responsible for the damages? I provided my insurance company info at that time. But I assume they didn't pay

Hi Kristy,

You should never assume anything.

Anytime you rent a car you are responsible for any damages. If you have insurance that should cover the situation that is fine, but, the rental car agency will still come after you if there are any issues with your insurance company.

You need to call your insurance company at the time of the incident and ask them specifically what happend in this claim. How much did they pay out, specifically for what, to whom did they pay it and when.

You need to call the rental car company and ask them if they received any payments from your insurance company, how much and for what and when.

You then need to coordinate all this information to see what may still be owed, find out why your insurance comapny has not paid it and then negotiate any balance that may remain. Do not just let issue go by the wayside or you may find yourself involved in a law suit that will cost you even more.
