Auto Insurance Claims: Hawaii rental company liability, tort liability, fault insurance

Question
My car was struck by someone driving a rental with fault 100 percent on the other driver. The other drivers insurance company refuses to cover the driver. Isn't my claim with the rental company as the owner of the vehicle? I understand Hawaii requires minimal liability coverage on the vehicle, not the driver. Many thanks, Mike

Answer
Hi Michael,
Hawaii is one of the eleven states that have no fault insurance.  Each state with no fault has a different plan and different laws.
My field of expertise is in tort liability (for the other 39 states).
I have no knowledge of Hawaii's plan nor do I know of anyone else on this site who is an expert on Hawaii no fault.
If your own insurance company can't assist you, you will probably need to retain an attorney.
Sincerely,
