Auto Insurance Claims: policy limits, uninsured motorist coverage, injury coverage

The time limit on filing my case is in a few months. It will be 2 yrs from the accident. My first question is; Is that 2 yr date the deadline for FILING my claim or SETTLING the claim? Second question is; The faulty party may only have $15k on bodily injury coverage. My costs exceed that. Do I file a claim anyway asking for more or is that the maximum they will give me? Also, the driver of the vehicle I was in has underinsured coverage for $60k. Do I make 2 claims trying to get the $65K I'm trying to claim???  THANKS!

The 2 year deadline is the statute of limitations for you to file a law suit. It is 2 years from the date of the accident. If you pass this dead line the insurance company does not have to pay you anything.

Yes you can claim uninsured motorist coverage from the car you were in. depending on your state you may also be able to claim on your own auto insurance if you have any.

You can only collect upto the policy limit from the at fault party's insurance company. The balance would be paid by the uninsured motorist coverage. However, these claim can be very difficult and if you do the wrong thing it could jeopardize your claim.

I would recommend that you speak with an attorney as soon as possible to be sure that your rights are protected.
