Auto Insurance Claims: whos fault in accident and claim, police number, driver responsibility

Hello

I was involved in accident on the parking tomorrow. I was settling my baby in the car seat. Before I opened the door to put her in there were nobody on the parking spot on my left side. So I was with my back to the parking spot on left from me and suddenly I saw the truck is trying to get into this parking spot by reverse, it was already parallel to my car so I didn't have time to close the door, I was trying to knock on it and shout to the driver to stop but he stopped only after he crashed into my door. I was lucky he didn't kill me.
The truck belongs to the cafe near the parking. I spoke with the cafe manager, he said he doesnt have police number cos they have insurance through the broker. He promised to call back to me when they'll get the claim number. Nobody called me the same day, so today I called to the office of the owner of that cafe, it seems that nobody knows about the accident, every time I'm trying to speak with the owner, the secretary's saying he's not in the office and he'll call me back. The same when I tried to ring the cafe and speak to manager.
So I called my insurance company if the can help me and the guy said the only thing I can do is to lodge the claim but I have to pay for the repairing cos it was my fault too. I don't get it how it can be my fault, I opened the door when the parking spot near me was empty, and this is the truck driver responsibility to look into both mirrors before he's getting to the parking spot in reverse. I'm also not sure if he was allowed to park there, I think the truck is too big and wide for it. If I have only the registration number can I check his model weight and dimensions somehow?

Hi Tania,

This is a difficult situation. Anytime you are in an accident you should always call the police to come and write a report.

Now it is your word against the truck driver. There will not be much you can do except file the claim on your own insurance.  The only alernative is to try to get the police to meet you at the cafe. Then meet with the owner to try to get the facts and have the police officer write a report. There is nothing else you can do. In the future always call the police no matter what the other person says.
