Auto Insurance Claims: Auto liability claim, uninsured motorist claims, uninsured motorist coverage

My Son was a passenger in a vehicle in which he was had serious injuries.Broken collarbone, shoulder blade.Fractured vertibrares, skull and sinsus cavity He does not have motor skills on the right side of his face. Other party had limit of $50,000 for liability limits. No settlements offered yet but they have said they will be offering the limit. Son has Unisured coverage of $50,000. I was adviced to contact my insurance company as he is a household member (has his own policy. I have limit of $50,000 with stacked coverage (3 vehicles). Can he get his limit and my limit of $150,000. Also have been informed his BC/BS will want to be reimbursed. Do they settle for full amount or what hospital takes. Medical bills so far are approx $55,000 but will have several more office calls and x-rays. Initial back to work or drive is 4/28 but if vision doesn't come back completely that will be extended. Suing is not a option has the driver is a friend. What do we need to watch for.

I'm sorry your son is going through this.

Not knowing what state you are is makes it difficult to answer. However, You will certainly be entitled to the at-fault person 50k as well as your sons uninsured motorist coverage of 50k. As to whether or not your son can get any of your UM coverage I do not know. Even though you said filing a suit is not an option, I would suggest that you be willing to pay any attorney to look over this entire situation and act as your coach through out the process. Uninsured motorist claims can be very tricky. You should not sign a representation agreement with an attorney that gives him/her 30% to 40% of your settlement because the injuries are serious enough that if you are entitled to the coverage you should be able to get all or most of whats available. Instead you shoud see if the attorney will work on an hourly basis simply providing advice and guidance. As for blue cross and blue shield, they will be entitled to reimbursement for whatever amounts they have paid out, from the settlement your son receives.
