Auto Insurance Claims: Airport parking scratches, airport parking lot, security cameras

Hi Richard,

I had parked my car at airport parking lot. After payment of my parking dues, I drove to my apartment parking lot (covered & secured). Next morning I noticed many scratches on the right rear passenger door. I promptly drove back to the parking lot and filed a claim with the company.
Parking lot manager told me that he would review security camera footage to see if the incident happened in the parking lot. Later next day, he said that the camera does not record any incident. However since the scratches are fresh, he is willing to see what he can do, If I can fax him an estimate for the repairs. After I faxed him the repairs, he was willing to pay $500 of $845.
I have already paid $ 300 for parking my vehicle in this lot and even with their reimbursement the total cost of parking to me will be $545. I know for sure that It could not have happened while the car was with me. Also, it is impossible for them to have their security cameras cover their parking lot for the 16 days, my car was parked there. In addition to this all the scratches are on the upper half of the door, indicating that it was probably a bigger vehicle. (like a pickup truck or van). I realize that most of my conclusions are inferences.

Please advise me about my options and chances of securing a full refund on the estimated damage of $844..

I will greatly appreciate your advise on my situation..

Hi Dhaval,

The is simply a matter of negotiation. In most cases the parking lot is not responsible for damage that occurs as a result of another vehicle hitting yours while parked on the lot. If they are accepting liability and stating that they are willing to pay, they should pay the entire cost. Keep in mind though that if you push too hard, they could simply refuse to pay anything and you would either have to pay all of it yourself ot take them to court. But without specific proof that they damaged your car, you would likely lose the case. Just do your best to negotiate the best deal you can.
