Auto Insurance Claims: auto insurance claim, auto insurance claim, small claims court

This is follow-up question to the one I sent earlier. I live in CA. There was no police report. My husband has never been in an accident and was not clearly at the time. The letter sent by the adverse insurance states that and I quote "Based on the facts presented to us, we see no liability on the part of our insured". There was no reason stated or is that the reason? I'm sorry I'm just confused. And by the way no one from the adverse insurance came by to look at our car or inspect the damage. We receive 1 call. and the letter of denial was dated 1 day after the accident. Please help.. Can i call the adjuster and ask if they have even seen the car and the damages?

Hi Marryanne-

It sounds like the other driver is not admitting he ran the red light or that he was at fault. So what would really help your case is if you had any witnesses.  You might try any businesses that were in sight of the accident to see if any employess saw the accident and could write down a statement.  
Other than that you need to find out what the dispute process is from the other insurance company and make a formal dispute of the finding.  You may have to go to small claims court.
