Auto Insurance Claims: Not sure whos at fault., smog check, exact layout


Question
Today, my boyfriend and I were at a shop getting his smog check. I parked my car near the office while his car was being worked on. After it was finished, I got in his car so he could drop me off. I got into my car and was about to pull out, but   the car next to me reversed before I could and ended up backing up into my boyfriends car. We all got out to talk about what happened. The guy who backed up into us told us it was my boyfriend's fault because he was "double-parked" behind him. But clearly, he didn't look behind to see if a car was there. He kept telling us he was not at fault because my boyfriend shouldn't have been there. So I'm not to sure who's at fault because many people told me if someone backs up into you, it's usually their fault.

Hi Christy,

Not knowing the exact layout of the parking lot or how the cars were situated it's hard to tell who is at fault. However, it makes no difference if someone is improperly parked. The person who hits a stationary object is generally at fault. If you were actually standing still and he backed up without looking then he is at fault.
