Auto Insurance Claims: 2nd rate Insuarnce Accident, company adjuster, own insurance

Hi,

I live in Texas and was recently hit by a driver that ran a red light.  There are 3 witnesses, all corroborate this fact.  The driver that hit me had insurance through her financier, considered 2nd rate.  She did not have proof at the time of the accident and was cited for no proof if insurance at the scene.

We are now at week 2 with no car and no rental.  Her insurance company would not give me any details because they said her insurance only covers her car and not mine.  I called my insurance company and at first they did not want to file the accident because it was her fault.  They have now assigned an adjuster, but they are not being very helpful.  She keeps saying they are waiting for the other insurance company adjuster to call them back and they are getting the run around.

What can I do?  I have uninsured on my car, is there a timeline that the adjusters are supposed to hold to once a claim is submitted?  Should I call a lawyer now or keep waiting?

From what you're telling me, it sounds like your own insurance company may be "2nd rate" as well.   Assuming that you have collision coverage, you can file against your own policy at any time.  They cannot stall you to wait for info from the other insurer.  

If you are trying to file under "uninsured motorist" only, then you will have to wait for everything to work through the process.  This may take several weeks.
