Auto Insurance Claims: settlement, elbow fracture, range of motion

We were broadsided (other driver 100% at fault), our 10 year old daughter suffered an elbow fracture on the growth plate, and the insurance wants to settle.  Her medical expenses were over $1000, what would be a fair settlement.  We only want what is fair, but have no idea.  This took place in the state of MO.

This answer is more difficult than you might think. In order to determine the value of this claim, one would need to review the medical file. You see the amount of the settlement is based on the severity of the injury, whether or not surgery was required, whether ongoing treatment will be necessary and it that any permanent disability or permanent loss of range of motion.

Without that information I would say to start out by asking for $10,000. Then be prepared to negotiate.

You could also ask an attorney, if the insurance company does not seem to be treating your fairly.
