Auto Insurance Claims: Auto Theft, farmers insurance, suspicious circumstances

Question
My 05 Tahoe was stolen back on the weekend of 10-12-2007. I have felt my insurance company has been looking for any excuse not to pay this claim. I have been told several reasons like my car payment was to high, the price of gas is high. Can they really use these excuses not to pay the claim? I was told today we are going to meet with their att. to do go under oath and I dont know if I should get an attorney when I know I was not involved with my car being stolen?

Answer
Hi Erma-

This is really out of my expertise but I can give you my best guess. I know that insurance companies do investigage larger claims aggressively.  If you aren't involved in fraud and if their aren't any other suspicious circumstances like you leaving the keys in your car or you were behind on your payments then I would say go through the process and see what their decision is and why.  If they see it's something in the policy that let's them not pay it then make sure you know exactly what it is and get a copy of it.  You can always get an attorney later and fight it.
Hope that helps.  Let me know how it works out.
