Auto Insurance Claims: car insurance, state insurance commissioners, full insurance

Question
Hello,
I drive a 2006 Jeep and I got in a car accident on 3/22/12.
When I called my car insurance to make the report, my company told me that the car only had liability insurance. The company stated that I fail to take the car for inspection in 2009 and since then I been driving with liability ins. I asked them if they ever notified my lien holder( the car last payment will be this september 2012) they stated yes. I called Chrysler and they said they had never recived such information. My car is destroyed and I dont have the money to fix it. I have 6 more payments to make and the insurance company said is my fault and they will not cover any fixings on my car!
Are car insurance companie mandated to report lack of full insurance? what about force car insurance. Help

Monica

Answer
Hi Monica,

Yes. The insurance company is required to notify you and the lienholder if the insurance is cancelled or any coverage is changed.

You should contact the insurance company and demand that they provide you with "Proof of mailing" to you. You should also contact the lienholder and ask them to request the same thing from the insurance company. If the insurance company can not produce the "Proof of mailing" then you may be able to force them to provide. To help move things along, you may want to also go ahead and file a complaint with your state insurance commissioners office. The insurance company may try to put you off but they will have to answer the insurance commissioner.

I hope this helps
