Auto Insurance Claims: How long to make a claim?, damage history, diminished value

I was rear ended in Los Angeles. The driver that hit me wanted to pay for the damage without involving the insurance companies. Almost 3 months has gone by and we have not been able to agree on a figure since he thinks the estimates are high. IS IT TOO LATE TO MAKE A CLAIM WITH HIS INSURANCE?

Hi Randy,

No it is not too late. You should simply explain to his insurance company that he said he would pay but is now unwilling to do so. Remembe that in addition to the cost of repairs you are also entitled to receive payment for a rental car during repairs and depending on the extent of the damage you may also be entitled to payment for the diminished value of your vehicle due to the damage history.
