Auto Insurance Claims: right to charge interests to unpaid settelments, settelments, settelment

I was rear-ended 13 months ago. I'm in the process of negociating my settelment with my agressors insurance. I have send a demand letter which they responded with a ridiculous offer of $18,175.00 USD. now I want to interests to my specials since I'm being charged interests from the hospital, chiropractors, ambulance etc. along with collection fees.
my specials add up to $13,825 USD. and I have demanded $30,000. I'd like to know what percentage of interests do I have the right to charge. thx

Hi Lucy,

Although, you have a right to demand payment of interest, it is unlikely that the insurance company will pay it unless ordered to by a judge. The standard interest would be 8%. However, you should concentrate more on achieving a reasonable settlement. The is a back and forth negotiation. You will need to send back a letter with a counter offer to settle. If they do not eventually get into a reasonable range then you may have to hire an attorney to file suit.
