Auto Insurance Claims: Insurance claim, preferred shops, insurance claim

Hello
I live in upstate ny.MY car was parked and struck in the rear by a construction vehicle as they baked up. I got a police report and the other party admited 100% fault. I phoned my insurance company and started to file a claim not knowing that  I probably should have just phoned the other persons Ins company to file the claim. The person at fault phoned me and asked if i wanted to get an estimate then have him cut me a check directly bypassing the insurance companies all together. The damage to my vehicle I anticipate to be 1-3K...
What dangers should I look out for when pursuing this avenue?

Hi Matt,
I strongly recommend that you continue using your own company and have it repaired at one of their 'preferred' shops.  Under these conditions, the insurance usually guarantees the repair work for as long as you own the car.
Once a body shop opens up the damaged area, they frequently find hidden damage that couldn't previously be seen.
If you accept a check from the construction company, you will be required to sign a 'release of all claims'.  That means you can never go back against them no matter what additional damage is found.
