Auto Insurance Claims: liability question, medical bills, san francisco bay area

Question
My son was in a car accident as a passenger. The driver has liability. The drivers insurance company called me today to discuss the accident. At the end of the call, he mentioned a settlement of pain and suffering. My son was taken to the ER, but had no serious injuries. How do they determine the amount of the settlement? We really just wanted our medical bills paid that our insurance did not pay. We live in the state of tn.

Answer
Hi Renea,
Your son is entitled for payment of his 'pain and suffering'.
That amount is usually 3 times his total medical bills.
If that total is less than $500, simply request a settlement of $1,500.
Your feedback by rating this answer would be greatly appreciated.
