Auto Insurance Claims: The guy hit the car didnt answer the insurance agent, adjustor, duty police

My daughter car was hit while she parked and went in the shopping center in Texas where she worked.  When she hard her car alarm, she went out to check her car.  A police standing by her car told her that her car was hit at the front by the car that was backing out of its parking space.  The police was patrolling the shopping center parking lot and saw the car hit her car.  The driver of the car addmitted he hit her car and provided her with his name and insurance information saying that he was responsible for reparing her car.  His car and insurance were owned by his father who lived in California. The driver's name was not listed in the insurance. My daughter called his insurance and got the claim number and an estimate from his insurance companey adjustor.  When she brought the car to a workshop, the workshop told her that the claim was still pending.  I called his insurance companey.  The agent of his insurance companey told me that she could not contact the guy that hit my daughter's car yet because he didn't call the insurance companey and he didn't answer the calls from the agent. She told me she called his father, but he didn't answer either. The agent told me that it would be 30 days before she had to assess liability and to inform me her decision unless the guy hit her car talk to the agent.  I didn't buy the insurance to cover my daughter's owen car. The police didn't issue the police report as I assume he was an off-duty police, or he though the incident was solved as the driver admitted he hit her car and agreed to repair her car at the scene.  Now, he is avoiding answering the calls from insurance agent and didn't contact.  Do I have to wait for 30 days? What can I do if his insurance companey deny the liability.  If I have to sue them who should I sue and in which coat should I file, in Texas or California? Please advise me what I should do now.  Thank you.

Hi Ken,

It is for this very reason that you buy insurance. The other insurance company can take upto 30 days to investigate and make a liability decision. You should make a claim to your own insurance to get your car repaired. Then your insurance will fight with the other insurance to get their money back or they will sue the owner of the car that hit you.
