Auto Insurance Claims: Am I responsible?, personal vehicle, company insurance

Question
I work at a group home for people with disabilities and at the house we have a company van.  There are two driveways at the house in which I work and my personal vehicle was parked in the front driveway that leads to the garage, which holds the company van.  This is the only day I had ever parked in the same driveway that the van uses to pull in and out of the garage.  When I got off work it was dark outside, but the next day I noticed a large dent and line of scratching down the drivers side on the backseat door and doorhandle of my car.  When I got to work the next day I realized that the brand new work van had black scratching (my car is black) on the passenger side rear bumper and it measured up exactly with the damage done to the side of my car.  I confronted my supervisor about this and he said their company insurance is not liable unless I find out who actually hit my car.  The company insurance covers all of my coworkers and I am the only person that doesn't drive the company van because I am only 20 years old and you have to be 21 to be on their insurance.  I called the police, but the police in my city don't do investigation on private property.  My mom contacted their insurance, but we haven't heard back.  Do you know if they will end up having to pay for the damage or will I be forced to pay my 1000$ deductible to get my car fixed?

Thank you for your time,

Stephanie Sailors

Answer
Hi Stephanie,

Their is nothing that will force them to pay anything. You will have to prove that someone there hit your car. You should take pictures of your car and the van to show that there is paint transfer as well as that the damage matches up. You should also start asking other employees if they know anything about the incident. It will be difficult, but if you can asseble enough proof you may be able to get them to pay.

I hope this helps
