Auto Insurance Claims: Insurance taking forever to settle claim, state insurance commissioners, field investigator

My car was heavily vandalized and was deemed total loss. It took the field investigator 3 weeks to get in touch with me. He would call me once a day during the EXACT hour even knowing that I would be working those hours. I would call him back repeatedly and he would never pick up. I had to call his boss to get him on the phone. So after his questions he said we're waiting on the police report. My liability adjuster told me they ordered the police report after I was questioned.

So my question is shouldn't they have ordered the police report from the start? Now it's been over 39 days since i first filed the claim.

What are my rights as a policy holder in California, what can I do to speed things up and What can I do about my insurance company. I called to complain and this adjuster told me they had as much time as they want as long as they proceed with the claim and as long as they sent me a letter saying so.

I'm tired of being victimized by my insurance company. Please help what can I do now? What are my rights? Who do I make a note to for their poor service?

Hi Charles,

In a vehicle theft situation the insurance company generally has 60 days to investigate and then either pay or deny the claim. If you do not feel you are being treated fairly, you can file a complaint with your state insurance commissioners office.
