Auto Insurance Claims: Offer, otc medicines, immediate medical care

Question
I was rear ended back in December 2006, the guy jumped out of his truck and offered me 300.00 on the spot to make it go away, it frighten me so I refused, he got the ticket and his insurance paid to fix my 2004 Mazda problem is that I did not seek medical attention although I was sore and hurting the next day and stayed off work for three days, because I did not seek medical care the adjuster is only offering me a one time payoff of 250.00 that won't even cover my days off. I regret now not going to the doctor but I feel that the 250.00 is just not enough, I was trying to be honest because I didn't think that I was hurt. I need a fair amount for the missed days of work, the OTC medicines that My husband purchased for me and I missed work later due to my back problems. I have gotten care since the accident but was told by the adjuster that it was to late to claim any injury's because I did not seek immediate medical care. I must also mention that I also rear ended someone a week before but did not file a claim because my Mazda did not hurt his big van one bit, but I mentioned that to the driver that hit me, he told the adjuster and the adjuster told me that I could have been hurt from that accident and if I had filed a injury claimed that would have denied it.

Thanking You In Advance
Vanessa

Answer
Hi Vanessa,

Insurance adjusters often will do or say just about anything to not pay  claims.

To get reimbursed for your days off work you will need to submit a statement from your employer indicating that you called in due to your car accident injury as well as indicating how much money you lost or how much vacation or sick time you lost. When you do not seek medical attention there is nothing for the adjuster to base your settlement on except for your word. Unfortunately many people will exagerate there injuries so the adjuster is skeptical.

There is not much you can do with out documentation of your injuries or treatment.  Just keep on top of them and eventually they may increase their offers to you just to close the file.

I hope this helps
