Auto Insurance Claims: Backing out of a parking space, parking lot accidents, case hi

In the state of Illinois I was driving my car  (in private property) when a man  was backing out of a parking space
and hit my car ?

Who is fault in this case?

Hi B,

There are many variables in parking lot accidents, sech as was it straight in parking or angled parking. Did your car hit the front, middle or rear of the other car.

Generally though, it is considered that the person backing up has the greatest duty to be sure he has a clear path to do so. It will likely be determined that you are at fault.
