Auto Insurance Claims: Auto accident, state farm insurance, state farm insurance company

Question
Driver at fault in auto accident State Farm Insurance Company refuses to make a reasonable settlement. They claim I have to take their offer within 60 days. What is the statute of limitations in Illinois in such matters? How can I find the Statute of Limitation? There was extensive property damage but no injuries.

Answer
Hi Mack,

In most states the statute of limitations for auto accidents is at least 2 years. A statute of limitations is the limit on time that you can bring a law suit if the claim is not settled by then.

I'm not sure of the details of your situation, however, if your vehicle was declared a total loss and your disagreement is over the value of the vehicle, you should request that they send you a copy of their documentation so you can review it for errors. If your disagreement is over the cost of repairs, you should put your vehicle into the body shop of your choice and ask the body shop to contact State Farm to negotiate the cost.

I hope this helps
