Auto Insurance Claims: Hit by a tree..., claim denials, insurance claim

Hi,
I am another victim of Insurance claim denials and came across this site for helpful hints. Recently I was in an auto accident, I was driving behind truck (RYDER) on the state highway ( with only 2 lanes) with trees on both sides. This truck hit the tree above it and the branches fell on my car broke the windshield and the car had lots of bruises all over and esp. where roof meets the windshield. The driver was an employee of XXX and company rented him RYDER's truck and didn't take any insurance from RYDER. I have only liability so my insurance denied it. RYDER denied it as company didn't take the insurance from them. And company's insurance company is also denying saying it was legible for the truck to go on that road its not their but the Tree owners fault and go after them.
In the meanwhile I have already spent towing + week rent from my pocket and the expenses for fixing the car is next in line.
I haven't contacted the tree owner ( I am not sure if it is privately owned or City/town owned). Please suggest Is their any way I can get my money back and from whom.

Any help in this matter will be really appreciated.

Hi Vishal,

This is a very difficult situation. About the only way you may have a chance of receiving any compensation is to file a law suit against the truck driver, his company and the tree owner. Then you will have to let the judge decide who, if anyone is liable.
