Auto Insurance Claims: Passenger in auto accident, external fixator, humerus

I was a passenger in an auto accident and received a significant injury. The driver of the car I was in was not at fault. The driver of the other car failed to stop at a stop sign before pulling onto a main road. My right humerus was broken in 5 places. I had surgery to repair my arm with an external fixator which I have had for 11 weeks. My medical bills will exceed $30,000 by the time I have the fixator removed and had physical therapy and will have been off work for at least 13 weeks. The insurance company says that the max they will pay is $25,000. My question is, I have under insured motorist coverage on my auto insurance so will it help pay since I was a passenger in someone elses car? I live in the no-fault state of Kentucky.

The simple answer here is yes, however, underinsured motorist claims can be very tricky. You may even be entitled to some coverage from the insurance of the car you were in.

I would highly recommend that you speak to an attorney to be sure that all coverage is known and that you get everything you're entitled to.
