Auto Insurance Claims: State Farm -Prior Damage Accident Claim, motorists insurance, white paint

Question
My daughter backed into a car in the driveway causing the very corner of the bumper on the passenger side of the car to dent. I had planned to have this fixed. In the meantime, I was rear ended by a truck which caused extensive damage to the very middle of the bumper.  There is white paint on my silver car from the truck and it is dented in.  The State Farm adjustor said that the prior damage would cost equal to the damage that truck did so therefore I do not have a claim.  I must go through the other motorists insurance company since I had prior damage.  My argument with them is I just want the damage that the truck did to my car fixed.  They stated that the prior damage would cause the bumper to have to be replaced and the new damage would also cause the bumper to be replaced.  So why am I the loser in this?  Why do I have to pay for all of the repairs?  and the truck that his me is off the hook?

Answer
Hi Ann,

The argument here is that if the old damage already would cause the bumper to need replacing then you are in no worse condition than before, because you still have the same condition, the bumper needs to be replaced.

You should make the claim directly to that at fault drivers insurance company. They too will likey make a deduction for the prior damage, but they will have to pay something.

I hope this helps
