Auto Insurance Claims: Claim Confusion, soft tissue injuries, personal injury insurance

I got rearended a week ago and reported the accident to my insurance company. I suffered both property damage and personal injury. Since then on, the other party's insurance claim adjuster communicates with me through phone and mails more than my own insurance claim adjuster. I have full coverage: personal injury/property liabiliy, collision, comprehensive, underinsure ...
Should my own insurance handles the case and pay my loss then go after the other insurance company? I've never run into this situation and don't know how to handle this, especially with the other adjuster's pressures.

Dear Ben,

Most people are in the same boat as you, and thus subject to abuses by the insurance adjusters UNLESS they arm themselves with information, just as you are doing now.  

It is up to you for making the choice of which insurance to use.  It depends upon the extent of your injuries and whether or not you have any health insurance that will cover your medical treatment.

The next topic for you is to be wary of the third party (at fault party) adjuster’s attempts to get you to commit to your condition NOW.  What if your soft tissue injuries worsen (as most do with exposure to physical activity)?  PLUS, he will be leaning on you to settle the claim too soon.  These are reasons why we advise our members to avoid any phone or recording conversations with the third party adjuster.  

DO NOT SETTLE YOUR SOFT TISSUE PERSONAL INJURY CLAIM TOO SOON.  I am always afraid when a third party adjuster is hounding you as this one is that he is going to try to get an early settlement.  Some soft tissue injuries can be lit up months after ending treatment.  Wait until you have gone through your summer season with all of its physical activities.  

There may be a dull ache at night following some physical activity or pain the next morning.  DO NOT LET LITTLE PAINS GO UNATTENDED SINCE YOU DO NOT KNOW WHETHER THEY WILL CONTINUE OR GO AWAY.  We all hope and believe that such little pains will disappear soon.  But on the other hand, we have no way of knowing since this is the way serious soft tissue injuries can behave.

Always communicate with the adjuster in writing, showing your own analysis of value. It is OK I guess to have one call or so, but no more.   Always have your information and ammunition in writing to give to the adjuster.

Let him know that you are FIRM IN YOUR RESOLVE to get what you are demanding (NOT "asking", since that invites a counter-offer, but instead "demanding" as fair and reasonable compensation) by asking him what the options are to resolve the matter fairly should he not agree to a reasonable claim value. In other words, let him know that you will go through with a court filing if need be.

Remember these tips, do your homework, print out your evidence, show resolve to get your fair settlement, and you will DO JUST FINE.
