Auto Insurance Claims: need some advice...getting taken advantage of, letter in the mail, case thanks

My girlfriend was waiting at a light and the person in front of her started to go then stop very abrubptly. She hit the back of his car. He claims that he just got the car back from the body shop...previous accident?? There apparently was a small scratch or rubb on the lower bumper panel. Before my girlfriend could get to his car he was on the phone with his insurance company, complaining like a baby, sorry very frustrated over this jerk. My girlfriend thinking that everything was ok gave him her info and did't ask for anything in return. She was nervous. Neither party admitted anything.

Now, a few weeks later she recieves a letter in the mail saying he has been injured and is sueing. There was never a police report filed, so who is to say it was her fault or how can he prove his case. We have still yet to talk to her insurance company. Just got it today.
Please help..need you advice. Does he have a case?

Hopefully, she's reported this to her insurance company as she is contractually obligated to do so.  The particular scenario illustrates why all claims must be reported in a timely manner.  It is the only way that the insurance company can begin to gather evidence and defend you before everything snowballs.

I cannot say if he has a case any more than her insurance company can at this point.

Please report the claim and they will make that determination.
