Auto Insurance Claims: Parking Lot Accident, pontiac bonneville, parking lot accident

Question
My son and his friend were backing out of parking spaces at the same time. We live in Michigan. This happened at night. My son was almost out of his space when struck by the other vehicle. The vehicles struck bumper to bumper. His friend apologized saying he did not see that my son was so far out in the driveway. They inspected the vehicles and both agreed that there was no damage and proceeded to leave. My sons car is a 2003 Ford Focus, his friends are is a 1998 Pontiac Bonneville. About a week later my sons friend advised my son that he had contacted his insurance company and led them to believe that it was sons fault. I have received an inquiry letter from the insurance company wanting my insurance information stating that there was over $1400 to their client. I refused to give them any information since my sons car does not have any damage to his and his friend admitted at the time of the incident that he was at fault and I do not want my insurance rates to go up. Because I have not provided insurance information the insurance company thinks we are uninsured. I have since received a letter stating that the insurance company is suing me. What can I do? Your advise would be appreciated.

Answer
Dear Quigley Roberts,

Send the letters to your insurance carrier ASAP, include a statement from your son regarding the above facts, and be there when they interview your son on the phone.

One worse thing than suing you would be to go thru your state's department of licensing and file a financial responsibility affidavit.  NOW THAT will get one's attention inasmuch as it will result in a license suspension until one posts financial responsibility for the accident.

Best to use your own insurance and dispute the claim.
