Auto Insurance Claims: what can i do about son car accident, kaisha, legal questions

My moms was the driver she was at fault, her boyfriend was also in the car along with my son that past in the accident.
The boyfriend gave my moms the keys with permission to drive with no license or Ins. I feel that the the boyfriengd should also shared the blame. The Ins. Company don't he gave my moms the keys. If I told them whats going Will I still be entitle to collect since my son was a passenger under the boyfriend ins. Will he be able to collect? Its a limited primary policy 15/30 and limited underinsured policy. The other wants 15,000
