Auto Insurance Claims: Claim troubles, lien holders, insurance adjuster

Question
I filed a claim with an insurance company of a truck that hit me. And they have told me before that they would write a check made out to the body shop where i got my estimate. Nobody i know has ever heard of anything like this. I don't want to get the car fixed i just want my money. So what should i do if the check is not made out to me. And also they wont mail me the check. I have to go down to the insurance company and pick it up. They say the reason for this is because I have to sign release forms. What is this about.

Answer
The insurance adjuster is in the habit of doing that on insured vehicles with lien holders.  It is a legal requirement.  More than likely, they just were not thinking when they told you that.  You can certainly receive a check made out to you alone as long as it's not your insurance company that is protecting a lien holder.
You do not have to repair the vehicle.
Let me know if they give you any more problems with that.
It is possible that the laws could be different in your state.
Good luck!
