Auto Insurance Claims: Claim time, claim time, insurance company


Question
I was in an accident where the other party is a minor. No police report was filed. Clearly it was her fault--she did not yield my green light while making a left turn in an intersection. I filed a claim directly with her insurance company and it has been over 2 weeks. Her insurance keeps telling me that they need a statement from her meanwhile my car goes unrepaired. I have considered just filing it with my insurance company and then suing her for the entire amount becuase I dont want to pay a deductible and I surely don't want my insurance to go up for a claim that was entirely not my fault. What is the normal procedures for this course of action?

Hi James,

In most states an insurance company has 30 days to investigate and either pay or deny the claim.

You can put the claim through your insurance company. They will then go after the other company to get back thier money plus your deductible.  As long as the claim goes down as not being your fault, there will be no effect on your policy or premiums.
