Auto Insurance Claims: Claim time, state insurance commissioner, juris doctor


Question
I was involved in an accident in which the other party was at fault. My question is their insurance company still hasn't paid to get our vehicle fixed even though it has been 2 months. I've called them weekly and each time they say they're waiting on the party at fault to get more information. Is there a time limit on how long they can drag this on?

They have EXCEEDED their investigation time.  If your vehicle was undrivable during this time, you are entitled to a rental car allowance, irrespective of whether or not you actually rented a car or had your neighbor drive you to work.

I would immediately prepare a complaint to your state insurance commissioner http://www.settlementcentral.com/links.php

Send a copy of the complaint to the claims supervisor, giving her three days to make arrangements for repair of your vehicle, or else you will file that complaint.

That should get you the proper results.
