Auto Insurance Claims: denied claim, state insurance department, copy of a lease

my son was taking our car to our daughters house to keep it there. (my husband had a stroke) the car was totaled. the insurance co denied the claim cause he was the driver. he has no insurance, but valid license, doesn't live with us. now i have to pay the car payments for three years. the salvage co said i had to write a letter, stating that i want to dispose of the car. which I did. both insurance co's looked at the car already. I have filed a claim with Massachusetts state insurance council on this also. my son just got his license in august, has his own apartment and pays rent. doesn't have a car, so what is the problem?  Is there anything else we can do?  Thanks, Faith

Hi Faith,

So far you seem to be doing everything correctly.  If you have not already done so, you should demand that your insurance company provide a written detailed explanation for their denial.  Unless there is something that I am not aware of, you can loan your car to anyone with a valid license as long as they don't live in your household.  You may need to provide a copy of a lease or utility bill in your sons name to prove that he does not live with you. Also the State Insurance Department should be able to help you get this straightened out.
