Auto Insurance Claims: Late Claim, accident occured, traffic courts

My boyfriend was driving my car & he was hit in the back by a driver with a suspended lincense. My car was parked at a stop light & the guy hit him from behind. My boyfriend also has a suspended license. Therefore, the guy who hit my car told my boyfriend that he would pay to fix my car. This accident occured on Nov 4th, 2006 & now the guy has come up with every excuse. I have lost my patience with him. My question's now are can I still report my claim? And if so, will my boyfriend get in trouble as well? Will my insurance co. pay for the claim? What are my options?

I'm assuming that the other party had no insurance?

If this just occurred last month, you shouldn't have any problem claiming this under your collision coverage. As long as the boyfriend had permissive use of your vehicle and that he doesn't live with you, you should have no problem.  There is no reason why the drivers license folks or traffic courts would be involved so I don't see how anyone would have to worry about those issues.
